What does a tenant rep broker actually cost?

The short answer: the broker is usually paid by the landlord, under terms disclosed in your written agreement. The longer answer explains why going straight to the landlord's agent rarely saves you money, and what you give up when you do.

A lot of small business owners assume that hiring a broker to find them space means adding a fee to an already expensive move. So they call the number on the sign and negotiate on their own. It is an understandable instinct, and in most cases it is based on a misunderstanding of how commercial leases are paid for.

How the commission usually works

When a landlord lists space for lease, it signs a listing agreement with its broker. That agreement sets a leasing commission, typically calculated as a percentage of the total rent over the lease term. When a tenant brings its own broker, the listing broker shares that commission with the tenant's broker.

The landlord has budgeted that cost before you ever call. It is part of the landlord's cost of filling the space, the same way tenant improvement allowances and free rent are.

Why going direct rarely helps

In many listing agreements, the listing broker earns the full commission if the tenant is unrepresented. The landlord's cost does not go down, so the rent does not either. What changes is that the only professional in the negotiation works for the other side.

What a tenant rep does for you

  1. Defines the requirement. Square footage, power, parking, loading, visibility and budget, written down before the first tour so you compare like with like.
  2. Finds the options you would miss. Including space that is not widely marketed yet, upcoming vacancies and subleases.
  3. Compares on an all-in basis. NNN charges, escalations, build-out costs and free rent change the ranking more often than you would think.
  4. Creates competition. Running more than one negotiation at once is the most reliable leverage a tenant has.
  5. Negotiates the LOI and lease. Rent, free rent, TI allowance, renewal options, expense caps, assignment and restoration terms.
  6. Manages the process. Coordinating with your attorney, contractor, lender and the city so the move-in date holds.

Representation in Colorado

Colorado requires real estate brokers to disclose the working relationship they have with you, whether they are acting as your agent, the landlord's agent, or as a transaction-broker who does not represent either side. Ask which one applies before you share your budget or your timeline. If the person on the other end of the phone represents the landlord, anything you tell them can be used in the landlord's favor.

When you would pay a fee

There are exceptions. Some engagements, such as a lease renewal where the landlord will not pay a commission, a consulting assignment, or a search for space that is not listed with a broker, may involve a fee paid by the tenant. A good broker will tell you up front if that is possible and put the arrangement in writing.

The bottom line

For most small businesses leasing space in Erie, Lafayette, Louisville, Longmont or Frederick, your own broker is usually paid by the landlord, under terms set out in writing, and it changes who is working for you. If you are starting a search, read the lease checklist and our local guides for Erie, Longmont and Lafayette.

Who pays the tenant's broker?

In most commercial leases, the landlord pays the commission under its listing agreement, and it is shared with the tenant's broker. Confirm your arrangement in writing before the search begins.

Will I get a better deal calling the listing agent directly?

Usually not. The landlord's commission is typically set whether or not you have a broker, so going direct rarely lowers the rent. It does mean nobody in the negotiation is working for you.

What does a tenant rep broker do?

Defines your requirement, finds and compares options on an all-in basis, negotiates the LOI and lease, and coordinates the process through move-in.
